Should Balochs trust in Judiciary?

The case of Baloch missing persons has not remained new. It is deteriorating day by day. The recovery of bullet-riddled dead bodies of Baloch missing persons increases unrest among the family members of Baloch political activists, teachers, writers, journalist, and lawyers, who have been missing for years.

Accordingto the Voice for Baloch Missing Persons, a sister organization of International Voice for Baloch Missing Persons, that more than 14000 Balochs belonging to diverse walks of life have been forcefully disappeared, allegedly by the law enforcement agencies collaborated the FC. Despite its striving for safe recovery of abducted Balochs, the Voice for Baloch Missing Persons has not been able to get recovered Baloch missing persons.

Though Amnesty International, Asian Human Rights Commission, Human Rights Commission of Pakistan, UN High Commissioner for Human Rights (OHCHR) have shown their concerns over the abduct and “kill and dump” of  Baloch youth  and urged Pakistan to vindicate her position against the allegations of Baloch student Organizations, Baloch nationalist parties and the lawyers organization, but  the state  authorities  rather than clearing their position  even  they called  the reports  fake and  anti-Pakistan moves .

 The relatives of Baloch missing ones on the platform of Voice for Baloch Missing Persons (VBMP) have been on strike and demanding for their safe recovery and if they are guilty they should be brought before the court. They have held myriad demonstration and protests, in Quetta, Karachi and Islamabad including more than twenty districts of Balochistan. According to the chairman of voice for Baloch missing persons Mr. Nasrullah Baloch, the protest for safe recovery of Baloch missing persons has passed more than 800 days but rather than safe recovery of their loved ones they have received more than 360 dead bodies of Baloch missing persons.

Apart from the claims of Voice for Baloch Missing persons we can find a great difference in the  fresh reports and statements of, IG FC, parliamentarian committee for missing persons and the order of Supreme Court of Pakistan, these statements and orders can cause a big clash between judiciary and law enforcement agencies and FC.

The family members of Baloch Missing Person always allege that Frontier Corps FC is involved in “Abduct kill and dump” of their loved ones, even recently the Balochistan police has presented proves against FC, kidnapping Baloch youths. Contrary to this Inspector General Frontier Corps (IG FC) Balochistan, Major General Ubaidullah Khan Khattak rejects the accusations that Balochistan FC not involved in enforced disappearances. He rejected the number of missing persons in a press conference, reported in Express Tribune on March 9, 2012. He says that the claims about the figure of missing persons are incorrect and it is merely propaganda. According to IGFC, the FC never whisked away any political activist in Balochistan or involved in practices of enforced disappearances.

The press conference of Justice (R) Javed Iqbal, reported on 9 June 2012, in The Nation and other newspapers of Pakistan brought a new turn in the case of missing persons in Balochistan. The press conference of Chief of Inquiry Commission on ‘missing persons’ of parliamentarian committee also does not go in the favor of missing Balochs, because the chief of commission Justice (R) Javed Iqbal has now reported in media that foreign agencies with a well-organized network and modern equipment are involved in the issue of missing persons and people from Marri and Bugti tribes who have gone to Afghanistan at their will cannot be considered as missing persons. This should be noted that Voice for Baloch Missing Persons has already boycotted the hearing of inquiry commission by saying that it is unauthorized commission and just wastage of time.

The issued interim order of Supreme Court on 20th of June, 2012, in a case pertaining to law and order in Balochistan, rejects all the statements of IGFC and Chief of inquiry commission Justice (R) Javed Iqbal. A three-judge bench headed by Chief Justice Iftikhar Muhammad Chaudhry heard the case. The court ruled that according to the reports law enforcement agencies were involved in the missing persons’ issue. The report about missing persons prepared by Inspector General of Punjab Police was also rejected by court saying that how a person who never visited Balochistan, can compile a report on the province.

Such steps of Chief Justice give hope to families who have been waiting for the safe recovery of their loved ones. No doubt, a large number of family members had to leave the hunger strike, held as protest for recovery of Baloch missing persons, when they were informed that the decomposed and bullet riddled dead bodies of their brothers, sons or husbands had been found. At least such orders of the court encourage the victim families to trust in judiciary. But how long it will last and when the missing ones will return to their homes, because till now more than 360 mutilated dead bodies of forcefully abducted Balochs have been recovered.

This is the high time if Chief Justice wants to have sustained trust of Baloch people it needs to take tangible measure concerned to the safe recovery of Baloch missing persons.
